This is when TREC determines whether or not you meet their qualifications for honesty, trustworthiness, and integrity through you submitting the Fitness Determination (FD) Form (Form FD-2), the Background History Form (Form BH-3), and a $50 check or money order made out to TREC. The forms are available for download at the bottom of this page. You can find the Fitness Determination Form by clicking here, and the Background History Form by clicking here.
You should only request this of TREC if you answer “Yes” to any of the questions below:
- Do you have any criminal offenses?
- Do you have any unpaid judgments?
- Have you had discipline taken against your professional or occupational license?
- Have you performed any unlicensed real estate activity?
If none of the above apply to you, you don’t need to worry about the FD.
Requesting a Fitness Determination:
If you need to request an FD, you should do this as soon as possible. The good news is that if you're looking to get a head start on your courses, you can do that while you wait to hear back about your FD. If you hear back from TREC that you're not eligible to pursue a real estate license at this time, just let us know within 30 days and we'll honor a full refund for you!
When filling out the form, disclose everything including all criminal offenses where you were placed on parole, probation, or community supervision (also known as deferred adjudication), even if the case was later dismissed. You will also need to provide any requested documentation or attachments - the sooner you do, the sooner your FD will be processed.
Full honesty is strongly encouraged because a background check is done for all applicants later in the licensing process and if something were to come up in the background check that was not reported in your FD documents, it could delay you significantly.
