I have a felony or misdemeanor on my record. Can I still be a real estate sales associate?

According to the Florida Real Estate Commission (FREC), each applicant will be considered on their own merits. When you apply, you’ll need to answer questions about your criminal history and provide back-up documentation. FREC will review and authorize approval on all applications with background issues. That approval process may take up to 90 days.

There are two possible scenarios: 

Non-Appearance Consent Agenda

This allows the application and all documentation submitted to be reviewed by FREC  without the applicant's appearance. FREC will make one of two decisions - the application is approvable and authorization will be granted to take the state exam or FREC requires additional consideration and will place them on the following month's Summary of Applicant Agenda.

Summary of Applicant

This agenda occurs after the application has been considered by FREC on the Consent Agenda and determined additional consideration is required. FREC  will ask the real estate staff to send a letter to the applicant notifying them FREC would like for them to appear. The letter will include the date, time, and location of the meeting.  It is not a requirement for the applicant to appear but it is strongly suggested so they can answer the additional questions FREC may have.
