I have a felony or misdemeanor on my record. Can I still become a real estate salesperson?

Along with a state and federal background check, several questions on your license application will cover felonies and convictions. If you answer yes to any of these questions, you will need to provide relevant details, including the type of conviction, the conviction date, and your status.

According to Virginia Law, “A person shall not be refused a license, certificate or registration to practice, pursue, or engage in any regulated occupation or profession solely because of a prior criminal conviction, unless the criminal conviction directly relates to the occupation or profession for which the license, certificate or registration is sought. However, the regulatory board shall have the authority to refuse a license, certificate or registration if, based upon all the information available, including the applicant's record of prior convictions, it finds that the applicant is unfit or unsuited to engage in such occupation or profession.”

Please contact the Department of Professional and Occupational Regulation if you have any specific questions about your eligibility to become a licensed real estate salesperson in the state of Virginia.
